Our attorney fees start at only $250 for a Joint Petition. If both parties are willing to cooperate with a Joint Petition divorce, the matter can be closed quickly without the need for a court appearance.
The laws of the State of Nevada have in place a form of divorce called a Summary Proceeding for Divorce, or more commonly, a Joint Petition.
A Joint Petition can only be used in the case of a totally uncontested divorce. All issues have to be agreed upon. Both parties must be willing to sign the divorce paperwork. One of the parties must be a resident of the State of Nevada, having been physically present and domiciled within the State for a least six weeks prior to the filing of the divorce paperwork. Only one party need provide what is called a resident witness; a person who also lives in Nevada and can sign an affidavit stating that they know one of the parties in the divorce action, see them on a regular basis, and know that they live within the state. Our office generally prepares all paperwork ready to be signed within 24 hours. The following sets forth exactly the cost of the uncontested Joint Petition:
Simple Joint Petition – No Property, Debts, or Children
Where there has been a very short marriage, generally less than a year, and no property or debts have been acquired during the marriage, and there are no minor children, the fees break down as follows:
|Electronic filing fee – Petition||$12.50|
|Electronic filing fee – Resident Witness||$3.50|
|Total Cost for the Entire Divorce||$625.00|
If there are property and debts to divide –
(a) If both parties simply keep the property and debts in their own possession –
|Additional Attorney Fees||$60.00|
|Total Cost for the Entire Divorce||$745.00|
(b) If there are assets and debts to divide, such as homes, vehicles, credit cards, pension benefits etc.
|Additional Attorney Fees||$65.00|
|Total Cost for the Entire Divorce||$875.00|
(c) If there are children
|Additional Attorney Fees||$30.00|

Note: An additional $25 fee is required if one of the parties to the divorce resides out of the state of Nevada. Also, if there is a business, multiple homes, or extensive assets, an additional fee of $100 – $400 fee is required.
Again, however, the only way a Joint Petition can be accomplished is if all matters are agreed upon between the parties. That includes child custody, child support, alimony (if any), the division of property and debt.
